Welcome to the Terms of Use for the Jewelers Mutual Group and its member companies* (collectively, "Jewelers Mutual," "we," "our" or "us"). The following terms and conditions ("Terms of Use") apply to visitors’ (“you” or “your”) use of our websites, mobile applications, and related online services (collectively, “Platforms”), including any content, functionality and services offered on or through them.

Please read the Terms of Use carefully before using the Platforms. By using or accessing the Platforms, you accept and agree to abide by these Terms of Use and our Privacy Policy, incorporated herein by reference. If you do not agree to the Terms of Use or Privacy Policy, do not use the Platforms. Your use of the Platforms shall constitute and be deemed your unconditional acceptance of these Terms of Use and the Privacy Policy.

Changes to the terms of use

We may revise and update these Terms of Use from time to time. The date these Terms of Use were last updated is identified at the top of the page. Your continued use of the Platforms following the latest update constitutes your acceptance of the updated Terms of Use. 

Restrictions on use

You may use the Platforms only for lawful purposes and in accordance with these Terms of Use. You may not use the Platforms in any manner that could disable, overburden, damage, or impair the Platforms or interfere with any other party's use of the Platforms; scrape, crawl, spider, harvest, or use bots or other automated means to access or collect data from the Platforms; reverse engineer, decompile, disassemble, or attempt to derive source code; bypass, test, or interfere with security or access controls, introduce malware or other harmful code; frame, mirror, or display the Platforms or content without our prior written consent; mine, extract, or publish performance or benchmarking information about the Platforms without consent; use the Platforms to solicit, market, or transact insurance or other products/services where not permitted by law; or violate any applicable law, regulation, or third-party rights. 

You may use the content of the Platforms only for lawful personal use. We may investigate violations, block access, remove content, suspend or terminate access, and refer matters to law enforcement where appropriate. The Platforms are not intended for children under the age of 18. By using the Platforms, you represent that you are an adult of 18 or more years of age. 

Accessing the platforms and account security

We reserve the right to withdraw or amend any service we provide on our Platforms at our sole discretion and without notice. We will not be liable if, for any reason, all or any part of our Platforms are unavailable for any period of time. We may restrict access to some parts of our Platforms to registered users.

We will not be liable if all or any part of the Platforms are unavailable at any time. We may restrict access to some areas or features to registered users. If you choose, or you are provided with, a username, password, or any credentials, you must treat them as confidential, log out at the end of each session, immediately notify us of any unauthorized access or security incident, and use particular caution on shared devices or networks. We may monitor, suspend, or terminate your access for actual or suspected violations of these Terms of Use. We can be contacted by any means on the Contact Us area of our website or on the Platforms. 

Electronic communications and E-Signatures

You consent to receive records, notices, and disclosures electronically, including by email, in‑app messages, and postings on the Platforms. You agree to keep your contact information current. You may withdraw consent where permitted by contacting us, but withdrawal may limit or terminate your ability to use certain features.

Privacy and information collection

Jewelers Mutual is committed to protecting your personal information. However, the privacy of communications over the internet cannot always be guaranteed because the internet is not a completely secure medium. For that reason, we assume no responsibility for losses or damages you may experience or incur by sending personal information over the internet. Please review our Privacy Policy for a description of the information that we collect or receive from you, how it is stored, and how it may be used and disclosed.

Third-party links and services

The Platforms may contain links to or integrations with third-party websites, services, processors, app stores, or content. These links are provided for your convenience only, and we do not control and are not responsible for third-party sites or services, their content, policies, or practices. Your use of third-party services is solely between you and the third-party and may be subject to separate terms and privacy policies. We do not endorse third-parties and are not liable for transactions with them.

Intellectual property rights 

The Platforms and all content, features, and functionality (including information, software, text, displays, images, video, and any audio) are owned by Jewelers Mutual or our licensors and are protected by United States and international laws regarding copyrights, trademarks, trade secrets and other intellectual property or proprietary rights. Except as expressly allowed, you may not copy, reproduce, modify, create derivative works of, publicly perform or display, republish, download, store, transmit, or distribute any content on the Platforms without our prior written consent. Our names, logos, and product/service names are trademarks of Jewelers Mutual or our licensors. You may not use any marks without prior written consent.

Reliance on information posted

Information presented on or through the Platforms is made available solely for general information. We do not warrant the accuracy, completeness, or usefulness of this information, and disclaim all liability arising from any reliance placed on it by you or others.

Disclaimer

We strive to provide accurate, useful and current information; however, insurance products, services, premiums, regulations and industry conditions change. Even the best website information and content is no substitute for personalized professional advice, tailored to your business or personal needs.

THE MATERIALS ON THE PLATFORMS ARE PROVIDED "AS IS." JEWELERS MUTUAL HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

NEITHER JEWELERS MUTUAL NOR ANY PERSON ASSOCIATED WITH JEWELERS MUTUAL MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE PLATFORMS. WITHOUT LIMITING THE FOREGOING, NEITHER JEWELERS MUTUAL NOR ANYONE ASSOCIATED WITH JEWELERS MUTUAL REPRESENTS OR WARRANTS THAT THE PLATFORMS, THEIR CONTENT OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORMS WILL BE ACCURATE, RELIABLE, ERROR-FREE OR UNINTERRUPTED; THAT DEFECTS WILL BE CORRECTED; THAT THE PLATFORMS OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR THAT THE PLATFORMS OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORMS WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JEWELERS MUTUAL, ITS AFFILIATES, SERVICE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORMS, ANY WEBSITES OR APPS LINKED TO THEM, ANY CONTENT ON THE PLATFORMS OR SUCH OTHER WEBSITES OR APPS, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORMS OR SUCH OTHER WEBSITES OR APPS. EXCEPT WHERE PROHIBITED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORMS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID TO JEWELERS MUTUAL FOR PLATFORM SERVICES (EXCLUDING INSURANCE PREMIUMS) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (E.G., FOR FRAUD OR WILLFUL MISCONDUCT).

The foregoing does not affect any liability which cannot be excluded or limited under applicable law. If the foregoing limitation of liability is not enforceable in whole or in part, then in no event shall Jewelers Mutual's total liability to a Platform user for any loss or damage shown to have arisen from the use of the Platform exceed the user’s internet access fees for the month in which the access leading to the proven loss or damage occurred.

Insurance coverages 

The Platforms may describe insurance coverages generally, and may not include all the benefits and limitations found in our policies. This information is not an offer, quotation, binder, or evidence of coverage. Coverage takes effect only upon our or the insurer’s confirmation and issuance of policy documents. The policy forms and endorsements govern if there is any inconsistency with information on the Platforms. Coverage and pricing are subject to underwriting review and approval, and applicable terms and conditions.

Authority to do business

Insurance products and services are offered in all 50 states, the District of Columbia and Canada by member insurers of the Jewelers Mutual Group, Neenah, WI, or via other carriers through JM Insurance Agency Partners, Inc. Service contracts are offered in all 50 states and the District of Columbia by members of the Jewelers Mutual Group, Neenah, WI. Not all products or services are offered in all geographical locations. We do not represent that the Platforms or their content are appropriate or available for use in every jurisdiction.

Reporting claims of copyright infringement

We respect the intellectual property rights of others and respond to notices of alleged infringement under the Digital Millennium Copyright Act (DMCA). If you believe that any material used on the Platforms or social media pages infringes your copyright or is the subject of infringing activity, you may request that we remove or disable access to such material by submitting notification in accordance with the DMCA to the Jewelers Mutual Group Privacy Office by contacting us at:
